roadway. it looks like we have avenue got lanes open now. following a couple of cars in the dark over here on this side of town. very much a difficult commute for you in the morning to see because of all of the trees out there. it looks like we've got lanes open if you are traveling on aviation boulevard. traveling northbound along i-95 this morning, for you guys traveling from dumfries up into dale city, about 53 to 59 miles per hour so maintaining speed. you will slow as you get closer to the occoquan and up in newington. no accidents to report on 66. earlier incident was as 123. heavy and slow leaving vienna headed eastbound towards the capital beltway. inner loop is in better shape annandale to merrifield. southbound along 270 coming in out of germantown, lanes are open headed for the lane divide. this morning's big story, president obama unveiling a plan that could help an

estimated one million home openers. >> it is a major chang to a 2009 program called the home affordable refinance program or harp that will allow home opener whose owe more than their home is worth to refinance. to qualify, you must be current on the mortgage payment. home observer already in foreclosure will not be able to benefit and your loan must be either owned or backed by fannie mae or freddie mac. the president announced this in las vegas where foreclosures affect about one in every 118 homes. >> if you meet certain requirements, you will have the chance to refinance at lower rates which could save you hundreds of dollars a month and thousands of dollars a year on mortgage payments. >> there is a lot more fine print to all of this including the fact that this is voluntary for banks. they can reject your refinancing request even if you meet all the requirements. we'll talk more about this with

fox business network ahead this hour and next hour, the vice president of fannie mae will joan us live. the president what in los angeles last night for two fundraisers. he outlined his administration's accomplishments saying he has done about 60% of what he set out to do and other 40% he can wrap up in the next five years. jury selection proving to be a bit difficult yesterday in the lululemon case. almost all of the potential jurors said she had heard of the case against brittany norwood. experts say the problem ever choosing a jury that is not partial is a big challenge. >> it is very difficult in any case if there has been publicity to put aside what you've heard or learned and certainly where air talk about

a high profile case like this. it is extremely difficult. >> jury selection continues today. opening statements are expected tomorrow. police still on the search if a hit and run driver who killed a pedestrian in northwest d.c. sunday. 32-year-old john young kim was dragged several yards and wound up in an alley near sixth street and florida avenue. neighbors say the driver may have turned into the alley to avoid traffic on florida avenue and that cars often speed through that alley. d.c. police are trying to track down bandits on bikes who are stealing smart phones right out of people's hands. one happened yesterday at 11th and f streets and police got several call for help on sunday near logan circle. one victim says some young men punched him in the face and demanded his phone. police hope a security camera in that area will help lead to an arrest. coming up next, a story of survival out of the aftermath after the turkish earthquake. less than a week after he was killed by rebel forces,

somewhere under the libyan desert lies the body now of former dictator moammar ghadafi. he was buried before dawn this morning along with his son in a secret location. a few witnesses who took a vow of silence were present at the burial. ghadafi's body was taken from a freezer last night where it had been on public display. in turkey, families of earthquake victims are mourning the loss of loved ones and are identifying bodies at a morgue. the number of dead is up to 366 this morning and 1300 are injured. hundreds more are still missing but authorities say the search for survivors could end later today. meanwhile a nine-year-old boy was pulled from the rubble after he was trapped for eight hours. seven months after a tsunami devastated the coast of japan, there is a new concern about all the debris. a russian freighter spotted about 20 million tons of

here in the district and in most major cities, honking horns just a part ofier day life. but five ever been to new york, you you know it is a different situation there. cab drivers being warned not to honk the horns unless it is an emergency it is not a new that you but they are starting to enforce it more. reminders going out to drivers

no incidents to report if you are traveling eastbound along 66. the win the we had at 123 has been moved over to the shoulder so the lanes are open. traffic is slow going headed into towards the capital beltway. if you are traveling in virginia, northbound along i- 95, no incidents to report leaving lakeshore top and newington but you are just below speed here at about 50 miles per hour headed up towards the beltway. that's a check of your fox 5 on-time traffic. >> thank you. netflix is facing fallout from unhappy customers. you know in the last few months, more than 800,000 subscribers in the u.s. ditched the service following a price hike and some other changes. company still has more than 23 million subscribers. netflix' shares fell 27% yesterday. a new proposal bit vatican to address the world's economic woes.

openers. lauren simonetti joins us from fox business network in new york. october has been off to a good start. is it more that europe is settling down or we are seeing good earnings here in the u.s.? >> it is good earnings here. many say if you pay attention to the latest stream of corporate profits, the latest being from caterpillar, the ceo saying there is political and economic uncertainty in the world but it is not affecting us. 73% of companies have beaten expectations. the dow is up nearly 105 points yesterday. and get this, up 1,000 points in the month of october. that is the biggest monthly gain since back in 1999, the dow and the knack are positive for 2011. the s&p 500 is very close. >> i like that. finally some good news and something nice to talk about. let's talk about housing right now and the harp program. kind of break this down as to what this means, who this affects and we heard from the president yesterday about this. >> right. the harp program, the home

affordable refinance program is more than two years old but it really hasn't worked. it was expected to keep millions of struggling underwater home owners in their homes and so far, through the program, not evening magazine one million have been able to use it. now, under new changes that will be fully announced mid- next month, the president and the white house are saying they are going to make refinancing much easier. if you are underwater on your home and you owe more on your mortgage than your hope is worth, that is okay. you can refinance. he is giving inisn'tives to the banks andlander out there to refinance. all in all, people are saying about one million people can stay in hair homes with the savings they get flu refinancing. the average is about $500 a year. proponents will say people will use that money, they'll invest it in stocks. opponents say hey, the white house has tried this for several years now. this isn't going to work.

the housing market is bad and this isn't the fix. that is the program and hopefully, it will work. >> and the banks could opt out of it or say no or decline the application but do they think that the incentives for the banks to actually go along with this will outweigh that? >> the problem right now is that there is really only four big banks that actually handle mortgages. back in the heyday, there were so many banks that did so the competition is pretty fierce right now so they don't have to promote all of these refinancings and the obama administration is trying to change that. how they are going to do it specifically we do not know yet but we are hearing that the inisn'tives will be pretty good so i guess, steve, i cannot answer your question. >> that's all right. you explained it well enough. thank you very much. we'll see you tomorrow morning. still head, a college student fighting for an inheritance that she says is rightly hers. find out why a charity benefiting from her stepfather's generosity is challenging her claim to the money. that is when fox 5 morning news

leaving 95 college park and headed around towards georgia avenue. it is about a 25-minute commute leaving route one headed around in towards silver spring. all of that overnight roadwork cleared. wrapping opportunity, if you are traveling in virginia off the beltway and continuing out towards 66, you will find your lanes are open. earlier problems that we had here at nutley street have cleared. traffic volumes heavy in manassas. that's a check of your fox 5 on-time traffic. jury selection continues today in the trial of a woman accused of killing a coworker at a bethesda yoga shop. >> selecting the jury is already proving to be a challenge. let's get the latest from stacy cohan. >> reporter: with every high- profile murder trial, it is very difficult but in particular the lululemon murder trial is drawing a lot of attention and thus a very difficult time selecting jurors. now, yesterday in court, 29- year-old brittany norwood said nothing as the jury pool came in. about 3 had you been in that jury pool altogether. half of those were questioned

yesterday. now, when asked how many of them had heard of this case, about 80% stood up. when asked how many had made up their mind about brittany norwood's guilt or innocence, 38 stood up and that is part of what is going to make it so difficult to select a fair and impartial jury. >> the jury select is probably the most important part of the trial. we are trying to get jurors particularly in this case who don't know the facts of the case, which is very difficult to do in any situation, particularly a high-profile case like this case. >> reporter: brittany norwood is charged with murdering jayna murray inside the lululemon store. the prosecution want to use graphic for the owes -- photos of the crime scene. the defense believes those photos would be far too

prejudicial and wants them out. the judge has yet to rule. back to you. >> thank you. a look at this morning's other top stories. police are investigating an apparent murder-suicide at a senior living community in montgomery county. officers were called to the national lutheran home in rockville yesterday morning. investigators say 80-year-old albert ballard went to visit his wife sandra who was a pay shouldn't at the home. several people reported hearing gunshots. police say they found the gun in sandra ballard's room. d.c. police are looking for a hit and run driver would killed a pedestrian in northwest d.c. on sunday. this happened near sixth street and florida avenue. 32-year-old john young kim was dragged several yards into an alley. neighbors say the driver may have turned into the alley to avoid traffic on florida avenue and the cars often speed through that alley. d.c. police trying to track down bandits on bikes who are stealing smart phones right out of people's hands. this one happened yesterday at

11th and s. several calls for help also went out on sunday near logan circle and northwest. one of the victims says police took him around the area in their cruiser looking for the young men who punched him in the face and demanded his phone. >> and then, when i got into the car with the cops riding around the neighborhood, they got three more calls about robberies with guys on bikes. >> there is a security camera where that man was attacked and police may hopefully find some evidence from that. how much is enough? that is a question being ask bid a local college student. >> a major charity is contesting her inheritance saying it belongs to them. melanie alnwick has the details. >> reporter: alicia decatur has fond memories of her stepfather. she says he helped raise her in this house. now, it and all of its contents are being sold while she fights for what barry left her. >> the most shocking thing i've ever experienced. >> reporter: he shot himself in

the kitchen march 28th, 2011. he left a suicide note. >> it said given my current health conditions and the situation, this is the best option for me. i hope god will forgive me. >> reporter: and an addendum to his will increasing alicia's inheritance to $100,000. >> he said i wish you the best in school. >> reporter: the bulk of his million dollar plus estate is going to a well high pressure known children's charity. in his first will, he willed everything to their shriner's hospitals for children. despite his handwritten change, attend two earlier revisions are being challenged. >> they are fighting for the $100,000. they are fighting for the $10,000 he left his nephew. >> reporter: richard lion, the attorney representing shriner's hospital, showed fox 5, it is our opinion that the jump should not have accepted the codicils.

tributes in birmingham, alabama to the late reverend fred shuttlesworth. he helped build the civil rights movement along side the reverend dr. martin luther king. helped to vince dr. king to come to birmingham. >> he was the incredible force and there were a lot of talented aand brave people

around martin but there was only one shuttlesworth around martin. >> he was one of the four founding ministers of the southern christian leadership conference. a new memorial at arlington national cemetery. it honors 14 jewish chaplains who died in service to the country since world war ii. it is next to memorials for protestants and catholic chaplains. jewish groups had been working for recognition for the rabbis who served during war time. protestors taking part in occupy d.c. have been camped out at macpherson square for some three weeks now. they are promising to stay put but safety issues are becoming a bit of a concern. maureen umeh takes a closer look. >> the makeshift kitchen at occupy d.c. could be considered ground zero. in the new battle, protesters are fighting against health and safety concerns raised since the movement began three weeks ago. heavy rains turned the site into a muddy mess leading officials with u.s. park police and d.c. to express concern.

violations could lead to enforcement and a possible shutdown so protesters have been self-policing. >> i believe they are probing us to try to find any way they can to shut us down and this is one way that they're trying to do that. >> we are trying to improve our facilities as we go. >> reporter: the kitchen is constantly being cleaned and food preparations handled with health in mind. protesters say area businesses have been allowing them to use their rest room or shower facilities but they say more is needed. >> we're working on this issue to get porta-potties to make sure that everybody keeps things clean. >> the protestors say their stay will be indefinite and they don't want to give any cause for removal or any reason to did h e -- destruct their ultimate mission. >> got a little bit of rain

thursday the way things are shaping up now. want to update you on hurricane rina. it is now a category two hurricane. better organized today. trying to form an eye there. it is threatening the yucatan peninsula, belize, cancun, places like that. there is a hurricane watch in effect for the east coast the yucatan peninsula. this is moving very slowly to the west-northwest. right now at about three miles per hour. it is almost just drifting so it does pose a threat down there. we'll keep our eyes on it during the course of the next 24, 36, 48 hours or so. forecast for us for today, and the next five days, today, a very, very nice day after the fog. we'll see plenty of sunshine. right around where we should be. our average high is 66 degrees. tomorrow, not bad, 71 but clouds will build nays the day progresses. i think thursday we'll see rain showers and then the main thing
